Terms and Conditions

1. Preamble

These Terms and Conditions constitute a legally binding document that governs the relationship between You and LLC “Contempo” (hereinafter — the “Company”), including but not limited to Your use of the website www.contempo.ge and the terms related to Product purchase and return.

All Customers who wish to purchase Products and/or receive services through www.contempo.ge are required to agree to these Terms and Conditions.

2. Declarations and Warranties

By agreeing to these Terms and Conditions, the Customer confirms that:

2.1. The Customer has full legal capacity to agree to these Terms and Conditions, enter into a contract with Contempo, and fulfill the obligations arising therefrom.

2.2. The Customer is a legally capable person acting of their own free will and is not under the influence of alcohol, narcotics, psychotropic substances, or any other means that would impair their ability to express free will. The Customer further confirms that no unlawful action (such as threats, coercion, violence, etc.) has been exerted upon them, and they fully understand the content of their expression of will and the resulting legal consequences.

2.3. The Customer will fulfill its obligations under the agreement duly, in good faith, and at the agreed time and place.

2.4. All information provided by the Customer during registration is accurate.

2.5. The Customer is not involved in or participating in any illegal activity as defined under the legislation of any jurisdiction (including money laundering, arms trafficking, terrorism, or any other illegal activities).

2.6. Contempo enters into agreements based on the declarations, warranties, and obligations outlined in these Terms and Conditions. Therefore, any breach of these statements after agreement formation will be sufficient grounds for Contempo to unilaterally refuse to provide any or all services stipulated in the agreement and these terms.

3. User Account Registration and Authorization

3.1. For the purpose of purchase Products or receive services via the www.contempo.ge website, the Customer is advised to register and create an account. The following data is required: name, surname, email, mobile number, date of birth, personal ID number, and country. To complete registration, the user must agree to the website’s Terms and Conditions and the attached Privacy Policy.

3.2. Customers must securely store their login credentials and never disclose them to third parties.

3.3. The Customer assumes full responsibility for any activity carried out through their account. If another person accesses the Customer’s account under their instruction or behalf, it is assumed that such person is authorized to bind the user to obligations. In no case will Contempo be responsible for damage caused by third-party access.

3.4. Customers shall ensure that their account information is accurate and kept up to date. Contempo will not be responsible for any damage arising from failure to comply with the above-said requirement. Contempo may request verification of information at any time.

3.5. Once registration is complete, the Customers may access and use the website via authorization.

Before making any purchase, Customers shall verify Product availability, color, or size with Contempo’s  representative via Facebook or the hotline:

• A Product may appear available online but may only be available for pre-order due to pending stock replenishment.

• Responses to inquiries are processed in the order received.

4. Delivery and Storage Terms

4.1. Delivery

4.1.1. Contempo will ensure the delivery of purchased Products to the Customer’s specified address within the following timeframes:

4.1.1.1. If the Product is in Tbilisi warehouse, delivery will occur within 7 (seven) business days from the purchase date, between 11 AM and 10 PM. Delivery cost: For orders under GEL 1,000 – GEL 30; For orders exceeding GEL 1,000 – without additional charges.

4.1.1.2. If the Product is not in Tbilisi warehouse and shall be ordered, the delivery terms are:

• If the Product is in stock in the Spanish warehouse — within 6–8 weeks.

• If the Product is not in stock and requires production — within 12–16 weeks.

4.1.2. Contempo states that transportation is by sea freight, and timelines may vary depending on the carrier.

4.1.3. The delivery person shall agree on the delivery time in advance with the Customer. If the Customer is not present, the delivery person is not required to wait more than 15 minutes. The cost of re-delivery in the Territory of Tbilisi will be GEL 30 and outside of the territory of Tbilisi will be 100% of transportation cost.

4.1.4. Delivery is available throughout Georgia, with prices agreed individually based on product size and type.

4.1.5. During delivery whether free or paid carrying the Product upstairs without an elevator is not included in Contempo’s services.

4.1.6. The Customer shall pay the full Product price upon delivery. In case the Product was ordered, the payment may be paid in two installments. If in such case the Customer cancels the order, the first installment is  non-refundable.

4.2. Storage

4.2.1. Products may be stored free of charge in Contempo’s warehouse for up to one month from purchase date.

4.2.2. After one month, the following weekly storage fees apply:

5. Warranty / Exchange and Return Policy

5.1. Products are covered by a 2-year warranty from the date of purchase.

5.2. The warranty does not apply if:

5.2.1. The warranty period has expired;

5.2.2. Physical damage occurred due to external or mechanical impact;

5.2.3. Damage was caused by Customer’s fault, negligence, or improper care;

5.2.4. The Customer assembled the Product by violation of instructions;

5.2.5. Operating conditions were not met;

5.2.6. A key product component has been altered or replaced.

5.3. A defect revealed during the warranty period refers to a fault occurring under normal use despite proper care.

5.4. To use the warranty, the user must present the purchase invoice and personal ID.

5.5. The warranty does not cover:

• Decorations;

• Tableware;

• Accessories;

• Products on which the Customer was informed in advance.

5.6. The Customer may return the Product based on the following:

1.  If the Product is purchased via the website— within 14 calendar days of receiving the product, without providing any reason. This does not apply if the Product was not located in a local (Georgia-based) warehouse at the time of purchase.
2.  If a manufacturing defect is found within 2 years of receiving the Product. In such case, the Customer may request an exchange or a refund if no replacement is available.

7.  The Customer must return the Product to a Contempo ‘s shop within 5 business days after notifying Contempo.
8.  Contempo is not responsible for return-related expenses unless the Product or its specifications do not match the website description.
9.  Refunds will be processed within 7 business days after return.
10.  Refunds will be issued via bank-to-bank transfer.
11. The Customer is not entitled to not return a Product if:
    1. It was made by Customer’s individual order;
    2.  It was ordered by the Customer;
    3.  It has been used;
    4.  It no longer retains its commercial condition, consumer properties, or packaging.
12.  For the avoidance of any doubt, if the damaged Product or any of its parts can be repaired, Contempo will carry out the repair. Only if the Product or its parts cannot be repaired will the above-mentioned Replacement/Refund policy apply.

6. Product Recipient

6.1. The Product may be accepted either by the registered Customer/the buyer or any other person present at the address specified by the Customer.

7. Governing Law

7.1. These Terms and Conditions are governed by and interpreted under Georgian law.

7.2. Any dispute arising between the parties shall be resolved through negotiation, and if no agreement is reached, the case shall be reviewed by the courts of Georgia.

8. Validity

8.1. These Terms and Conditions, and any amendments or additions, remain in effect until the Customer’s account is deleted.

9. Final Provisions

9.1. These Terms and Conditions and other related documents represent the full agreement regarding the Website and Services, superseding all other communications/agreements, whether written or oral.

9.2. If any clause or part of these terms is rendered invalid or unenforceable, the rest will remain in effect.

9.3. Contempo reserves the right to unilaterally amend these Terms and Conditions, notifying Customers via the website.

9.4. Any matters not addressed herein will be regulated by Georgian legislation.
